Agenda Title:

Request from Cummins Central Power, LLC, for a Variance to Waive the Requirement to Install Sidewalk Along N. Elk Vale Road and Taggart Road for Lot 2R, I-90 Heartland Business Park, Section 28, T2N, R8E, BHM, Rapid City per City Ordinance 12.08.060.

Summary:

            A request was received in the Engineering Office on 12/15/15 requesting the requirement to install sidewalk along N. Elk Vale Road and Taggart Road per City of Rapid City Ordinance 12.08.060 be waived. A 5’ sidewalk is required to be constructed along N. Elk Vale Road and Taggart Road at the time of building permit, with the property having approximately 342 feet of frontage along both N. Elk Vale and Taggart Roads. The requested variance will allow for construction of a vehicle and RV repair facility on the property, including short term RV parking/camping, without the installation of sidewalk in the adjacent right-of-ways.  This property is located in a planned development (14PD036).   Adjacent N. Elk Vale Road is a principal two-lane arterial street with a center turn lane, no sidewalk and a rural street section with ditches to accommodate drainage.  The closest pedestrian access routes in the N. Elk Vale Road right-of-way are at the intersection with E. Mall Drive, approximately 550 feet south of the property.   Adjacent Taggart Road is a two-lane local street with curb & gutter and storm sewer to accommodate drainage.  There is existing sidewalk at the parcel located at the northwest corner of Taggart Road and Galt Court, approximately 100 feet north of the property; along with sidewalk on the entire north side of Galt Court.  There is also sidewalk on a portion of the north side of Seger Drive, approximately 800 feet north of the property. 

          There is one option for sidewalk; install the sidewalk 1 foot inside the right-of-way on both roads which may have conflicts with the roadside ditch on N. Elk Vale Road.

          Based upon N. Elk Vale Road being a principal two-lane arterial street with ditches, a posted speed limit of 50 miles per hour and the lack of pedestrian traffic in the area, it seems reasonable to allow a variance to the sidewalk requirement until development in the area necessitates construction of pedestrian access.  The Rapid City Council has the authority to order in sidewalk at any time, should sidewalk in this area become necessary.

           Since the City has required sidewalk for the more recent building permits within the business park on Taggart Road and Galt Court, it is reasonable to require sidewalk on Taggart Road and deny the variance request.

Recommendation:

Action: Choose an item. Approve a variance to the sidewalk requirement for N. Elk Vale Road.   Deny a variance to the sidewalk requirement for Taggart Road.
